Florida’s new personal injury protection insurance law, or PIPwill mean that the injured individual must be astute enough to act quickly to qualify for compensation to pay for medical expenses due to their injuries. They should got to an emergenvy roon right from the accident scene and not wait to be seen by a physician.

According to Lisa Spitxzer Msw who oversees the Referal Servce " It is important that people act quickly now to obtain medical treatment so that they do not lose the benefits they are entitled to".
House Bill 119 is an amendment to the PIP law adopted in 1972 to ensure that anyone injured in a Florida auto accident would quickly get money to treat their injuries.

The bill, which was adopted during the recently completed legislative session, requires injured people to obtain medical care within 14 day of their injury. The care must be from a physician, osteopath, dentist, chiropractor, physician’s assistant or advanced registered nurse practitioner, or from a hospital or in a facility. We suggested going straight to the ER from the accident scene to protect your rights.

Also, a physician, osteopathic physician, dentist, supervised physician’s assistant or advanced registered nurse practitioner must determine that the individual has had an “emergency medical condition” for them to qualify for the full $10,000 medical benefit defined in the PIP law since its inception. Without declaration of an emergency medical condition, the insurance payment is capped at $2,500

Legislators say the law’s changes will reduce insurance fraud. Others disagree. It remains to be seen who the beneficiaries will be.

 Insurance Companies:
     10% reduction in insurance company billing for PIP benefits in October 2012 and 25% reduction in billing for PIP benefits in 2014 but the insurance companies have right to petition for exclusion from the above.

 Law Enforcement
    A long form accident report must now be done in every accident involving death, injury, pain complaints, if wrecker is required or if collision involves a commercial vehicle.

 Fraudulent Claims
    This new statute allows a penalty for false applications in insurance policies and benefits. This portion of the statute reiterates laws already in effect on insurance fraud.

Effect on the Injured
    The ten thousand dollars ($10,000) personal injury benefits are restricted to a showing by a medical doctor, doctor of osteopathic medicine, dentist, physicians assistant or registered nurse practitioner that the auto accident injuries constitute a need for Immediate Medical Attention such that absence of medical care would result in:

  •         jeopardy to health
  •         impairment of bodily functions or
  •         dysfunction of bodily organ or parts

1) A person must seek medical  intervention within 14 days of the accident, otherwise, PIP coverage is waived;
2) PIP will only provide $2500 in benefits unless the injured  is deemed having an emergency medical condition.

Interestingly enough it will be more difficult to get help for simple whiplash or build up medical bills for minor injuries. This will mean that the treatment of sprains, whiplash and fender benders may not be the deep medical pocket they once were. I wonder how the accident mills will get arounf this one ? It is more important then ever to make sure you are signed up with an experienced auto accident lawyer.

The bill approved by lawmakers attempts to  wipe out  fraudulant medical treatment by requiring accident victims to seek medical treatment ,preferably at a hospital emergency room ,within 14 days.
