GENERAL INFORMATION ABOUT WORKERS COMPENSATION

Workers compensation laws were created to help employees (and dependents of employees) who are injured or disabled on the job. The Law provides for monetary recovery while eliminating the need for a lawsuit. Workers compensation lawyers use these laws to protect people injured on the job. Some laws also protect employers and fellow workers by limiting the amount an injured employee can recover from an employer and by eliminating the liability of co-workers in most accidents. Georgia and Florida statutes establish this framework for most employment. Federal statutes are limited to federal employees or those workers employed in some significant aspect of interstate commerce. The Federal Employment Compensation Act provides workers compensation for non-military, federal employees. Many of its provisions are typical of most workers' compensation laws. Awards are limited to "disability or death" sustained while in the performance of the employee's duties but not caused willfully by the employee or by intoxication. The act covers medical expenses due to the disability and may require the employee to undergo job retraining. A disabled employee receives two-thirds of his or her normal monthly salary during the disability and may receive more for permanent physical injuries or if he or she has dependents. The act provides compensation for survivors of employees who are killed. The act is administered by the Office of Workers' Compensation Programs. Workers compensation is administered on a state-by-state basis, with a state governing board overseeing varying public/private combinations of workers compensation systems. The federal government has its own workers compensation program with its own requirements for federal employees. In most states, workers compensation is solely provided by private insurance companies. 12 states operate a state fund (which serves as a model to private insurers and insures state employees), and a few states have state-owned monopolies. To keep the state funds from crowding out private insurers, they are limited to assigned-risk programs and acting as insurers of last resort, and they can only write workers compensation policies. In contrast, private insurers can reduce workers compensation costs by turning away the worst risks and can write comprehensive workers compensation insurance packages covering general liability, natural disasters, and so on. Of the 12 state funds, the largest workers compensation fund is California's State Compensation Insurance Fund. The federal government pays its workers compensation obligations for its own employees through regular appropriations.
